Terms of Service

These terms govern your access to and use of Appartable. By creating an account, you agree to be bound by them.

1. Who we are

Appartable (the "Platform", "we", "us") is operated from Switzerland. Our full legal contact details are available on our Imprint page.

2. Acceptance of terms

By accessing or using Appartable you confirm that you have read, understood, and agreed to these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

3. Eligibility and account creation

  • You must be at least 18 years old to create an account.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account.
  • You may not create more than one account or impersonate any other person.

4. User obligations

When using Appartable you agree to:

  • Use the Platform only for lawful purposes and in accordance with these Terms.
  • Treat other members respectfully. Harassment, discrimination, hate speech, and abusive behaviour are strictly forbidden.
  • Not post false, misleading, defamatory, infringing, obscene, or otherwise unlawful content.
  • Not use the Platform to send spam or unsolicited commercial messages.
  • Not attempt to gain unauthorised access to our systems, scrape data, reverse-engineer the service, or interfere with its operation.

5. User-generated content

You retain all rights to the content you upload (profile information, photos, listings, messages, etc.). By posting content on Appartable you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and process that content for the sole purpose of operating the Platform.

You are solely responsible for the content you submit. We may remove or restrict any content that violates these Terms, applicable law, or the rights of third parties.

6. Platform responsibilities

We strive to keep Appartable available, secure, and accurate. However, the Platform is provided "as is" and we do not guarantee uninterrupted availability, freedom from errors, or that the matching algorithm will produce specific results. We are not a party to any rental agreement or relationship formed between users.

7. Listings and rental agreements

Appartable facilitates introductions between renters, roommates, and landlords. We do not inspect properties and we do not act as a real-estate agent or broker. Any rental or roommate agreement is concluded directly between the parties involved and is governed by the applicable provisions of the Swiss Code of Obligations.

8. Fees

The core Appartable experience is currently free. We may introduce paid features in the future, which will be clearly identified as such and require your explicit consent before any charge is made.

9. Liability limitations

To the maximum extent permitted by Swiss law, Appartable's liability for any damages arising out of or in connection with your use of the Platform is limited to direct damages caused by gross negligence or wilful misconduct. We exclude all liability for indirect, incidental, or consequential damages, including loss of profits, loss of data, or damages arising from interactions with other users.

10. Suspension and termination

We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, or to protect the safety of our community. You may delete your account at any time from your profile settings.

11. Changes to the service or terms

We may modify the Platform and these Terms from time to time. Material changes to the Terms will be communicated by email or on the Platform at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction (dispute resolution)

These Terms are governed by the substantive laws of Switzerland, excluding its conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The parties shall first attempt to resolve any dispute amicably. If no amicable solution can be reached, the exclusive place of jurisdiction shall be the competent courts at the registered office of Appartable in Switzerland. Mandatory consumer protection provisions granting consumers a right to sue at their place of residence remain reserved.
